Program Details
This program will provide direction and advice from three accomplished judges on the unwritten rules and best practices for courtroom conduct, communication with other counsel and the impact of your overall approach to the law practice and your community reputation. The program will be moderated by a managing partner for a San Francisco complex litigation firm who will provide suggestions for successfully navigating the law office environment.

The panel for this program consists of some of the most accomplished lawyers in our state who have excelled in both private practice and in their service on the bench of the California Superior Court. This event provides a unique opportunity for newly practicing lawyers to learn the insights from these individuals whose stellar careers reflect their excellent grasp on many of the unwritten rules and practice approaches critical to success in the legal profession.
Program Speakers
Honorable Winifred Smith
Judge Winifred Smith received her juris doctorate from Boston University School of Law in 1974. She was appointed to the Alameda Superior Court in November 2000 and currently presides over Civil Direct Calendar Trials. Before her appointment, she served from 1974-2000 as a deputy attorney general for the State Department of Justice in San Francisco and handled complex state and federal litigation related to health and welfare issues.
Judge Smith serves on a number of court committees and was an active member of the Judicial Council’s Access and Fairness Advisory Committee from 2004-2007. She currently serves on the Continuing Judicial studies Program Committee of the Center for Judicial Education and Research.
Throughout her career, Judge Smith has been active in a wide variety of legal services and bar activities, and in 2006 she was honored as “Judge of the Year” by the Charles Houston Bar Association.
Honorable James P. Kleinberg
Judge Kleinberg is currently the Supervising Judge of the Complex Civil Division. As with the other 16 complex civil departments in California, the case load includes class actions, securities, corporate governance, construction, and intellectual property litigation through trial. Prior to his appointment to the bench in 2002, Judge Kleinberg was a civil litigator with over 34 years’ experience in both state and federal courts. After graduating from the University of Michigan Law School he was a Trial Attorney with the U.S. Department of Justice, Antitrust Division.
Judge Kleinberg currently serves as an Advisor to the State Bar’s Section of Litigation, is a member of the American College of Business Court Judges, a director of the Association of Business Trial Lawyers, and a Holton Teaching Fellow at the Haas School of Business, UC Berkeley.
Honorable James L. Warren (Ret.)
Judge Warren has been involved in many of San Francisco Superior Court’s most high profile cases. He has presided over cases involving a wide range of legal issues, including high-stakes insurance, complex employment and environmental suits. prior to his appointment to the bench, he was Senior Counsel for Pacific Bell in San Francisco where he was primarily responsible for large and complex commercial litigation.
Previously, Judge Warren practiced for nearly twenty years with Pillsbury Winthrop (formerly Pillsbury, Madison & Sutro) where he specialized in anti-trust and large commercial cases and was founding Chair of the firm’s Intellectual Property Specialty Group. He is known for his insightful analysis, creative problem-solving, and warm but firm manner with all parties.
Judge Warren currently serves as an alternative dispute resolution Arbitrator with JAMS.
Lisa Cappelluti
Ms. Cappelluti is the managing partner of the San Francisco office of Lorber, Greenfield and Polito, LLP. Her firm specializes in complex construction actions ranging from contract disputes and unfair business practice claims to construction defect actions, delay and impact claims, mold exposure and construction injury cases.
Ms. Cappelluti is the Chair of the State Bar of California Litigation Section Executive Committee.
